Welcome to Birdsong. By creating an account or using the app, you agree to these Terms of Service ("Terms"). Please read them carefully. If you do not agree, please do not use the app.
1. The service
Birdsong is a bird-identification tool available as a website and as mobile apps for iOS and Android. You can record or upload audio, and the app uses artificial intelligence to suggest the most likely species, along with a field guide, a personal journal, and an optional community feed for subscribers.
2. AI accuracy & no expert advice
Identifications are generated by automated AI models and are provided on a best-effort basis only. They are estimates, not authoritative determinations. Birdsong does not guarantee that any identification, range assessment, or fact is accurate, complete, or current.
Do not rely on the app for scientific research, legal, regulatory, safety, conservation, hunting, or any decision where accuracy matters. Always confirm important findings with a qualified human expert or authoritative source.
3. Your account
You are responsible for keeping your login credentials secure and for all activity under your account. You must provide accurate information, be at least 13 years old (or the age of digital consent in your country), and not share your account with others except as part of an authorised Family plan.
4. Signing in with Google or Apple
You can create or access your account using a third-party sign-in provider, currently Sign in with Google and, on iOS, Sign in with Apple, or with an email and password. When you use a third-party provider, it authenticates you and shares a limited set of profile information (such as your name, email address, and profile picture) with us, as described in our Privacy Policy. We request only basic profile and email access and do not receive your provider password.
Your use of those providers is also governed by their own terms and privacy policies. You are responsible for keeping any third-party account you use to sign in secure; if you lose access to it, you may lose access to your Birdsong account.
5. Subscriptions, billing & auto-renewal
Birdsong offers a free tier and paid ("Pro") plans, currently available as monthly, annual, and Family subscriptions. The plan name, billing period, and price are shown to you at the point of purchase before you confirm.
Pro plans are auto-renewing subscriptions: unless you cancel, your subscription automatically renews at the end of each billing period and your payment method is charged the then-current price for the next period. Where a free trial or introductory offer is provided, it automatically converts to a paid subscription unless you cancel before it ends.
How you are billed and how you cancel depends on where you subscribed:
- Web: payments are processed by our payment partners (RevenueCat and Stripe); manage or cancel from the billing portal in the app.
- Apple App Store: payment is charged to your Apple Account, and the subscription is managed and cancelled in your Apple Account settings, subject to Apple's terms.
- Google Play: payment is charged to your Google Play account, and the subscription is managed and cancelled in your Google Play settings, subject to Google's terms.
To avoid being charged for the next period, cancel at least 24 hours before the current period ends; cancellation takes effect at the end of the period and you keep Pro access until then. Except where required by law or by the applicable app store's policies, payments are non-refundable. Prices may change with reasonable notice.
6. Purchases through the App Store and Google Play
If you download Birdsong from the Apple App Store or Google Play, the following also applies, and for App Store downloads these Terms (together with our Privacy Policy) are your end-user licence agreement (EULA):
- This agreement is concluded between you and Birdsong only, and not with Apple Inc. or Google LLC. The app store operators are not responsible for the app or its content.
- We grant you a non-transferable licence to use the app on any device you own or control, as permitted by the applicable app store's Usage Rules.
- Birdsong, not the app store, is solely responsible for the app and for providing any maintenance and support, for which the app stores have no obligation.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims are Birdsong's responsibility.
- Birdsong, not the app store, is responsible for addressing claims relating to the app, including product-liability, legal or regulatory, and intellectual-property claims.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist-supporting," and that you are not listed on any U.S. Government restricted-parties list.
- Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, may enforce them against you. Google LLC is likewise a third-party beneficiary with respect to apps obtained from Google Play.
7. Your content & community
You retain ownership of the audio, photos, notes, and other content you submit ("Your Content"). By sharing Your Content to the community feed or any public area of the app, you grant Birdsong a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and distribute that content for the purpose of operating, promoting, and improving the service.
You represent that you have the rights to the content you submit and that it does not infringe anyone else's rights. This licence ends when you delete Your Content, except for copies already shared with others or retained as required by law or for backups.
8. Acceptable use
You agree not to:
- Post unlawful, harassing, hateful, deceptive, or infringing content;
- Disturb wildlife, trespass, or violate any wildlife-protection laws while using the app;
- Scrape, reverse-engineer, resell, or build a competing dataset from the app's content;
- Abuse, overload, or attempt to bypass usage limits, paywalls, or security;
- Upload malware or impersonate any person or organisation.
9. Intellectual property
The app, its name, logo, design, illustrations, generated field-guide content, and software are owned by Birdsong and protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable licence to use the app for its intended purpose. No other rights are granted.
10. Termination
You may stop using the app and delete your account at any time. We may suspend or terminate your access if you breach these Terms, misuse the service, or where required by law. On termination, your right to use the app ends immediately.
11. Disclaimers & limitation of liability
The app is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and accuracy. To the maximum extent permitted by law, Birdsong is not liable for any indirect, incidental, or consequential damages, or for any loss arising from reliance on an identification or other app output. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.
12. Changes & governing law
We may update these Terms from time to time; material changes will be notified in the app or by email. Continued use after changes means you accept them. Nothing in these Terms limits any mandatory statutory consumer rights you may have, and where an app store's policies apply to a purchase made through that store, those policies control for that purchase. These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules.
